Terms of Service for Command

PLEASE READ THESE TERMS AND CONDITIONS OF USE CAREFULLY. BY ACCESSING OR USING COMMAND, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS DESCRIBED HEREIN. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE THIS SERVICE. THESE TERMS AND CONDITIONS CONTAIN A BINDING ARBITRATION PROVISION IN SECTION 14 THAT AFFECTS YOUR RIGHTS.
These Terms of Service ("Terms") govern your access to and use of the Command platform and services (including our website, web-based applications, mobile applications, and any other tools, products, or services provided by Command that link to or reference these Terms) (collectively, the "Platform"). The Platform is provided by Infinite Game Ventures Inc, doing business as Command ("Command," "we," "us," or "our"), located in Indiana, United States.
Command reserves the right to change or modify any of the terms and conditions contained in these Terms at any time and in its sole discretion. Any changes or modifications will be effective immediately upon posting the revised terms on the Platform. We will use reasonable efforts to give you notice of material modifications, such as posting notice on the Platform or via email, and you waive any right you may have to receive specific, individual notice of such changes or modifications. By continuing to use our Platform after we post changes or modifications, you confirm that you accept those changes or modifications. If you do not agree to the amended terms, you must stop using the Platform.

1. Description of Service
Command is a volunteer coordination platform designed for grassroots organizations. We provide software tools for volunteer engagement, training, task management, event coordination, communications, analytics, and leadership identification.
The Platform serves two categories of users:
Organizations: Nonprofits, advocacy groups, campaigns, and other mission-driven organizations that subscribe to Command to manage their volunteer operations. Organizations are represented by their authorized administrators who create accounts, manage settings, and are responsible for their organization's use of the Platform.
Volunteers: Individuals who sign up through an organization's signup forms, event pages, or the Command volunteer network to participate in volunteer activities. Volunteers create their own accounts and agree to these Terms upon registration.
2. Privacy Policy
Please refer to our Privacy Policy for information on how Command collects, uses, and discloses your information when you use the Platform. By using our Platform, you agree that we can collect, use, and share data from you as described in our Privacy Policy. We are not responsible for any information that you share with others via your use of the Platform. You assume all privacy, security, and other risks associated with providing any information, including personally identifiable information, to other users of the Platform.
If you submit feedback or suggestions about the Platform, you agree that we may use your feedback or suggestions without obligation to you.
3. Text Messaging
Command may send you recurring, automated text messages ("Text Messages") related to your volunteer activities, including task reminders, event notifications, streak updates, training reminders, and other platform notifications on behalf of organizations that use our Platform.
Consent: Your consent to receive Text Messages is obtained when you provide your phone number during signup and opt in to receive notifications. Your consent to receive Text Messages is not a condition of using the Platform, and you can cancel this service at any time.
Opting Out: You may opt out of receiving Text Messages at any time by texting STOP to any message you receive from Command. After you send STOP, we will send you a reply message to confirm that you have been unsubscribed. You may also manage your notification preferences in your account settings.
Help: For help with Text Messages, text HELP to any message you receive from Command, or contact us at daniel@commandleaders.com.
Message Frequency: Message frequency varies based on your activity and notification preferences. You may receive daily task reminders, event reminders (typically sent 24 hours before events), streak notifications, and other notifications based on your engagement with the Platform.
Rates and Carriers: Message and data rates may apply. Neither Command nor participating carriers guarantee that Text Messages will be delivered. Carriers are not liable for delayed or undelivered messages.
You may receive Text Messages even if your phone number is on a corporate, state, or national Do Not Call list or registry, as these lists do not apply to transactional or informational messages related to services you have signed up for.
Command may discontinue its Text Messaging program at any time, without notice.
4. Email Communications
In connection with your use of the Platform, we may send you service announcements, administrative messages, signup confirmations, event updates, task reminders, re-engagement messages, and other information via email.
Transactional Emails: You will receive transactional emails necessary for the operation of the Platform (such as magic link authentication, event confirmations, and account notifications). These emails are part of the service and cannot be opted out of while you maintain an account.
Marketing Emails: If you have opted in to receive promotional or marketing communications, you may opt out by clicking the "unsubscribe" link in any such email. Please be aware that there may be a brief period before we are able to process your opt-out.
5. Volunteer Network
Command operates a volunteer network that enables volunteers to discover opportunities across multiple organizations that use our Platform.
Network Participation: By creating a volunteer account on Command, you agree to participate in the Command volunteer network. This means you may browse events and opportunities from organizations across the network, and your basic profile information (first name, last initial, and general location) may be visible in aggregate contexts such as leaderboards.
Action-Based Data Sharing: Your contact information is shared with an organization only when you take an action with that organization, such as signing up for an event, completing their signup form, or RSVPing to an opportunity. Simply browsing the network does not share your contact information with organizations.
Opting Out: You may opt out of network participation at any time through your account settings. If you opt out, you will still be able to use Command with organizations you have already signed up with, but you will not appear in network-wide discovery features or receive suggestions for opportunities from other organizations.
Network Terms: We may update the network participation terms as we develop new features. Material changes will be communicated to you, and continued use of network features after such changes constitutes acceptance.
6. Your Account
You may need an account in order to use certain aspects of the Platform or sign up for events and activities. If you create an account, you agree that all registration information you provide will be accurate and current. You will timely notify us of any changes to your information.
You are responsible for controlling access to any devices you use to access the Platform. You agree that you will be solely responsible for all activities that occur under your account.

7. Subscriptions and Payment (Organizations)
Command is offered to organizations as an annual subscription. Payment is due at the start of each subscription period. Prices may change with 30 days notice before your next renewal.

8. Your Data and Data Ownership
Organizations own the volunteer contact information they collect through Command, specifically names, email addresses, and phone numbers, and any content they create or upload to the platform, such as training materials and event descriptions. We do not sell this information to third parties.
Platform-generated data, such as engagement metrics, activity scores, streak counts, and leaderboard data, is produced by Command to operate and improve the service.
Data Export: Organizations may export their volunteer contact list (names, emails, and phone numbers) at any time using our export feature. If you cancel your subscription, you may request a data export within 30 days of cancellation.
Volunteer Data: Volunteers own their personal information. Volunteers may access, correct, or request deletion of their personal data as described in our Privacy Policy. When a volunteer signs up with an organization through Command, that organization receives the volunteer's contact information in accordance with the volunteer's consent.
9. User Content and License
The Platform includes areas in which organizations may upload, post, store, and share content, including training materials, event descriptions, messages, and other materials ("User Content").
Ownership: You retain ownership of your User Content. Command does not claim ownership of any User Content you submit to the Platform.
License to Command: By posting, uploading, or otherwise submitting User Content to the Platform, you grant Command a nonexclusive, worldwide, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and publicly perform and display your User Content solely for the purposes of operating, promoting, and improving the Platform and developing new features and services. This license continues even if you stop using the Platform, but only with respect to User Content that was shared with other users or displayed publicly prior to termination.
Content Standards: You represent and warrant that you have the necessary rights to grant us this license, and that your User Content does not violate these Terms or any rights of any person or entity. You agree not to post User Content that is unlawful, defamatory, obscene, threatening, invasive of privacy, infringing of intellectual property rights, or otherwise objectionable.
10. Acceptable Use
You agree not to use Command for:
- Activity that violates applicable law
- Harassment, threats, or abuse of individuals
- Distributing malware or attempting unauthorized access to systems
- Misrepresenting your identity or organizational affiliation
- Sending spam or unsolicited bulk communications
- Scraping, data mining, or using automated means to access the Platform without permission
- Interfering with or disrupting the Platform or servers
- Any use that violates applicable campaign finance laws or regulations
Command is not responsible for the conduct of any user on or off the Platform, or for any content posted by any user.
11. Platform Commitment
We will not terminate your account based on your political positions or advocacy goals, provided you comply with these Terms. Our acceptable use policy is based on legal compliance and the standards set forth in these Terms, not viewpoint.
12. Account Termination
By You: You may cancel your subscription or delete your account at any time. For organizations, access continues through the end of your paid subscription period.
By Us: We may terminate accounts that violate these Terms. If we terminate your account for reasons other than illegal activity or serious Terms violations, we will provide 30 days notice and a data export opportunity. In cases of illegal activity or serious Terms violations, we may terminate immediately.
Effect of Termination: Upon termination, your right to use the Platform will immediately cease. Sections 9, 12, 13, 14, 15, and 16 will survive termination of these Terms.
13. Disclaimer and Limitation of Liability
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. COMMAND DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMMAND AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM.
IN NO EVENT WILL COMMAND'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OF LIABILITY FOR CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS OR LIMITATIONS MAY NOT APPLY TO YOU.
14. Binding Arbitration and Class Action Waiver
Agreement to Arbitrate: You and Command agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Platform (collectively, "Disputes") will be resolved through binding individual arbitration rather than in court, except that either party may bring an individual action in small claims court if the claim qualifies.
No Class Actions: YOU AND COMMAND AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF REPRESENTATIVE OR CLASS PROCEEDING.
Arbitration Procedures: The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as modified by this Agreement. The AAA Rules are available at www.adr.org. The arbitration will be conducted in English. A single arbitrator will be selected in accordance with the AAA Rules. The arbitration will take place in Indianapolis, Indiana, unless you and Command agree otherwise or the AAA Rules provide otherwise.
Arbitration Fees: If your claim is for $10,000 or less, Command will pay all arbitration fees. If your claim is for more than $10,000, arbitration fees will be split according to AAA Rules. However, if the arbitrator finds that your claim was frivolous or brought for an improper purpose, you agree to reimburse Command for all fees associated with the arbitration.
Opt-Out: You may opt out of this arbitration agreement by sending written notice to daniel@commandleaders.com within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of the arbitration agreement.
Severability: If any part of this arbitration agreement is found to be unenforceable, the remaining portions will remain in effect. If the class action waiver is found to be unenforceable, then the entirety of this arbitration agreement will be null and void, and Disputes will be resolved in court.
WAIVER OF JURY TRIAL: WHETHER IN COURT OR IN ARBITRATION, YOU AND COMMAND AGREE TO WAIVE THE RIGHT TO A TRIAL BY JURY TO THE FULLEST EXTENT ALLOWED BY LAW.
15. Indemnification
You agree to defend, indemnify, and hold harmless Command, its affiliated companies, and their respective directors, officers, employees, agents, and contractors from and against any claims, losses, damages, costs, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your violation of these Terms; (b) your User Content; (c) your violation of the rights of any third party; or (d) your misuse of the Platform.
16. General Provisions
Governing Law: These Terms are governed by the laws of the State of Indiana, United States, without regard to its conflict of laws provisions.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Command regarding the Platform and supersede all prior agreements.
Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable and will not affect the validity and enforceability of any remaining provisions.
No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
Assignment: You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

17. Copyright and Intellectual Property
"COMMAND," the Command logo, and any Command slogans or taglines are trademarks of Infinite Game Ventures Inc and may not be copied, imitated, or used without prior written permission.
The Platform and all content and materials on the Platform, including designs, text, graphics, software, and the selection and arrangement thereof, are the property of Command or its licensors and are protected by United States and international copyright laws.
Copyright Complaints: If you believe that any content on the Platform infringes your copyright, please send a notice to daniel@commandleaders.com containing: (1) identification of the copyrighted work; (2) identification of the allegedly infringing material and its location; (3) your contact information; (4) a statement that you have a good faith belief that the use is not authorized; (5) a statement under penalty of perjury that your notice is accurate and that you are authorized to act on behalf of the copyright owner; and (6) your physical or electronic signature.
18. Third-Party Content and Events
Command may display information regarding or provide links to third-party events, websites, content, or services. Command does not endorse or control, and makes no representations or warranties regarding, any such third parties or third-party content. Your participation in third-party events or use of third-party services is at your own risk.
Your attendance at events organized through the Platform is at your own discretion and risk. Command is not responsible for any loss or damage incurred as a result of attending events or activities coordinated through the Platform.
By using Command, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
